Tennessee is suing the FCC over a ruling to pre-empt Tennessee state laws regarding municipal broadband. The ruling was issued on the same day as the Open Internet order. The suit, in the U.S. Court of Appeals for the 6th Circuit, says the FCC's action is unconstitutional, in excess of the commission's authority, and arbitrary, capricious, and an abuse of discretion.
