USTelecom and the state of Tennessee are suing the FCC over its recent actions on Net Neutrality and municipal broadband.

USTelecom is petitioning the U.S. Court of Appeals for the District of Columbia Circuit for review of the FCC's Open Internet Order, which the commission adopted on Feb. 26. The suit says the FCC order is "arbitrary, capricious, and an abuse of discretion" and a violation of federal law, among other objections. Tennessee is suing the FCC over a ruling to pre-empt Tennessee state laws regarding municipal broadband. The ruling was issued on the same day as the Open Internet order. The suit, in the U.S. Court of Appeals for the 6th Circuit, says the FCC's action is unconstitutional, in excess of the commission's authority, and arbitrary, capricious, and an abuse of discretion.
